The bad news is SCOTUS will hear the mandates case.
Citizens want SCOTUS to give them moral vindication, one way or another. The special session will happen on Friday, January 7th. Just in time to let mandate-opposing academics start their teaching semesters & then get banned from campus only to screw up their students’ schedules. But hey, it won’t interfere with SCOTUS’ regular session.
But it won’t matter. Because the mandates aren’t there to enforce public health. The mandates are there to enforce the power of the state. Out in the open. So you will make no mistake about the forces that have charge over you.
The public health measures aren’t about the vaccinated or unvaccinated.
Today, the presidency has usurped about all it can possibly usurp without just coming outright & becoming a cult of personality. Or the bait & switch: public health cult of personality.

Meantime, I have $3 that says SCOTUS won’t block the vaccine mandates.
One, SCOTUS won’t be making a decision about anything to do with vaccines. They won’t even be deciding whether a vaccine mandate effectively violates any civil liberty, like, say right to privacy or freedom of association. [Tsk. That would be like being a priest.]
The justices will be deciding only whether the president has the authority through the Departments of Labor [through OSHA] or Health & Human Services [through CMS] to issue the mandates.
And that’s how you get a purely bureaucratized judiciary. A final political arbiter that decides not to decide.
Two, a conservative majority in the Court, during a Democratic Party administration, with both houses of Congress majority Democratic Party members, are subject to the possibility that court packing, term limits, or jurisdiction stripping is in their future. It’s been floated by the Democrats for 3 years. To show good political faith & to avoid that the court will decide for the administration’s mandates.
Bernie Sanders was against court-packing in 2020. But that was because he was proposing a presidential-discretionary rotation of justices on-off SCOTUS & back into the federal bench elsewhere.
Bernie’s everyman mittens are the academic expert class version of Tyler Childers singing about poverty in coal country, minus the self-knowledge. And I like Bernie.
The justices appointed by Trump want to demonstrate that they are not his political handmaids. And besides, Trump’s fortunes are waning, even if the Republican party is not without possibility in the fractured state it’s in.
The president’s commission is mostly Harvard & Yale legal academics. Their 6-month investigation is charged to yield non-binding recommendations.
Third, the Court stays in its legitimation zone when it follows—instead of leading—public opinion. The corporate-dependent media is telling a cartoon story of a tiny minority of deplorables-neo-Nazis opposing the mandates because they are flat-earthers. It’s propaganda. The truth lies elsewhere: in massive protests [mostly in Europe, but the US is not immuned] school board meetings, truck stops, church social halls, coffee houses, furtive faculty signals, and chat rooms. You know, those working people academics talk about championing. The literate class has given away its legitimacy by closing disputation out of the universities.
Do you want underground resistance? Because that’s how you get underground resistance.
The vaccine mandate opposition is growing every day. Those who thought Fauci was the sexiest man alive, saving them from the evil Donald Trump, only to become disenchanted with Biden’s threats, will become bright-eyed as the days of boosters & contact tracing come out as new permanent reality—smart cities & soylent in your fridge. You won’t have to worry about unwanted pregnancy, getting fat, paying rent, voting, or having a conscience anymore. The biosecurity state will take care of everything.
What’s the difference between a conspiracy theory & reality? About 6 months.
SCOTUS: the final arbiter of what the state says it can do to the people without their consent. The court will decide for the mandate. Because it is the state, too.
